BigLogPro Trading Academy — Terms of Use

1. Acceptance of Terms

By accessing, viewing, or using any content within the BigLogPro Trading Academy ("Academy"), including but not limited to training modules, articles, videos, PDFs, and any associated educational materials ("Content"), you ("User," "you," "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Academy.

These Terms are in addition to, and supplement, the BigLogPro general Terms of Service and Privacy Policy.

2. Proprietary Content and Intellectual Property

2.1 Ownership

All Content within the Academy is the exclusive property of BigLogPro and is protected by United States and international copyright, trademark, and intellectual property laws. The Content, including but not limited to text, graphics, data compilations, curriculum structure, original analysis, and presentation format, constitutes original work authored by BigLogPro.

You may NOT:

Reproduce, duplicate, copy, sell, resell, distribute, or exploit any Content for any commercial purpose without the prior written consent of BigLogPro.
Modify, adapt, translate, reverse-engineer, decompile, or create derivative works based on any Content.
Remove, alter, or obscure any copyright notices, trademarks, or other proprietary rights notices from any Content.
Share, forward, upload, post, or transmit any Content to any third party, website, platform, social media account, or file-sharing service.
Use any Content to create competing educational materials, courses, or products.
Scrape, data-mine, or use automated tools to extract Content from the Academy.
Frame, mirror, or embed any Content on any other website or platform.
Use any Content in connection with any artificial intelligence training, machine learning datasets, or language model fine-tuning.

2.4 Permitted Use

You MAY:

Access and view the Content for your personal, non-commercial educational use.
Download PDF versions of Content that are made available for download, for your personal use only.
Take personal notes based on the Content for your own trading education.
Share links to publicly available Academy pages (not the Content itself) with others.

3. Not Financial Advice

3.1 Educational Purpose Only

The Content provided through the Academy is for educational and informational purposes only. Nothing in the Academy should be construed as financial advice, investment advice, trading advice, tax advice, legal advice, or any other type of professional advice.

3.2 Not a Registered Advisor

BigLogPro is NOT a registered investment advisor, broker-dealer, financial planner, certified financial analyst, or any other type of licensed financial professional. BigLogPro is a software company that provides a trading journal and analytics platform with supplementary educational content.

3.3 No Recommendations

No Content within the Academy constitutes a recommendation to buy, sell, hold, or otherwise transact in any specific security, financial instrument, strategy, or trading approach. Any references to specific securities, ticker symbols, strategies, indicators, or market conditions are used solely for educational illustration and are not endorsements or recommendations.

4. Risk Disclosure

4.1 Trading Risk

You could sustain a loss of some or all of your investment capital. Do not invest money that you cannot afford to lose.

No trading system, methodology, strategy, indicator, or educational program can guarantee profits or ensure freedom from losses. Past performance of any trading approach, whether actual or hypothetical, is not necessarily indicative of future results.

You are solely responsible for your own trading and investment decisions. You acknowledge that you make all trading decisions independently and that BigLogPro bears no responsibility for any financial losses you may incur as a result of applying concepts learned through the Academy.

While BigLogPro strives to provide accurate and up-to-date educational content, we make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of any Content.

5.2 Third-Party Data

Statistics, data points, and factual claims cited in the Content are sourced from publicly available regulatory filings, academic research, and industry reports. BigLogPro does not independently verify all third-party data and makes no warranty as to its accuracy or timeliness.

5.3 Market Conditions Change

Financial markets, regulations, trading platforms, and market structures are subject to change. Content that is accurate at the time of publication may become outdated. BigLogPro is under no obligation to update Content to reflect changes in market conditions, regulations, or other factors.

6. Subscription and Access

6.1 Free Content

Certain Academy Content may be designated as publicly accessible without a BigLogPro subscription. Access to free Content does not create a subscription relationship.

6.2 Subscriber Content

The majority of Academy Content is available exclusively to active BigLogPro subscribers. Access to subscriber Content requires a current, paid BigLogPro subscription in good standing.

6.3 Access Termination

BigLogPro reserves the right to modify, suspend, or terminate access to any Content at any time, with or without notice, for any reason, including but not limited to violations of these Terms.

7. User Conduct

You agree not to:

Use the Academy for any unlawful purpose or in violation of any applicable local, state, national, or international law.
Attempt to gain unauthorized access to any portion of the Academy or any systems or networks connected to the Academy.
Use the Academy in any manner that could damage, disable, overburden, or impair BigLogPro's servers or networks.
Impersonate any person or entity in connection with your use of the Academy.

8. Limitation of Liability

8.1 Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIGLOGPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE ACADEMY OR ANY CONTENT.

8.2 Total Liability Cap

IN NO EVENT SHALL BIGLOGPRO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE ACADEMY EXCEED THE AMOUNT YOU HAVE PAID TO BIGLOGPRO FOR YOUR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8.3 Trading Losses

BIGLOGPRO SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY TRADING LOSSES, INVESTMENT LOSSES, OR FINANCIAL DAMAGES INCURRED BY YOU, REGARDLESS OF WHETHER SUCH LOSSES ARISE FROM YOUR USE OF ACADEMY CONTENT, RELIANCE ON INFORMATION IN THE ACADEMY, OR OTHERWISE.

9. Indemnification

You agree to indemnify, defend, and hold harmless BigLogPro, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Academy, your violation of these Terms, or your violation of any rights of a third party.

10. DMCA and Copyright Infringement

BigLogPro respects the intellectual property rights of others and expects users to do the same. If you believe that any Content infringes upon your copyright, please contact us at support@biglogtraders.com with the relevant details.

BigLogPro will aggressively pursue all available legal remedies against any person or entity that infringes upon BigLogPro's copyrighted Content.

11. Modifications to Terms

BigLogPro reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Academy following any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Grayson County, Texas, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

14. Entire Agreement

These Terms, together with the BigLogPro Terms of Service and Privacy Policy, constitute the entire agreement between you and BigLogPro regarding the Academy and supersede all prior agreements and understandings.
