Terms of Service

1. Acceptance of Terms

By accessing or using BigLog Pro ("Service"), operated by Crossland Network Solutions ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service. By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

2. Description of Service

BigLog Pro is a trade journaling and analytics platform that allows users to:

  • Import and track trading activity via CSV upload or manual entry
  • Analyze trading performance with pattern analytics and statistics
  • Replay trades with historical chart data
  • Generate reports, including tax reports
  • Maintain a trading playbook and pre-trade checklists

Important: BigLog Pro is a READ-ONLY journaling and analytics tool. We do not execute trades, provide investment advice, manage portfolios, or have direct access to your brokerage accounts. We are not a registered broker-dealer, investment adviser, or financial adviser. All trade data is imported via CSV files you provide or entered manually by you.

3. User Accounts

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept full responsibility for all activities that occur under your account

You may not share your account credentials with any third party or allow multiple individuals to use a single account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free Trial, Subscription, Billing & Cancellation

4.1 Free Trial

New users receive a 14-day free trial with full access to all features. When you start a free trial, you are required to provide a valid payment method. If you do not cancel your subscription before the end of the 14-day trial period, your payment method will be automatically charged the applicable subscription fee ($39/month) without further notice. The free trial is limited to one per person, household, or payment method.

4.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period (monthly) at the then-current subscription rate. By subscribing, you authorize us to charge your payment method on a recurring basis. You will be charged on the same date each month (or the nearest available date if that date does not exist in a given month). It is your responsibility to keep your payment information current.

4.3 Cancellation

Cancellation is entirely self-service and is the sole responsibility of the User. You may cancel your subscription at any time through your account settings panel within the application. Upon cancellation, you will retain access to the Service until the end of your current paid billing period, after which your subscription will not renew.

BigLog Pro is not responsible for continued charges if you forget to cancel your subscription. It is your responsibility to manage your subscription and ensure timely cancellation if you do not wish to continue. Cancellation must be completed at least 24 hours before your next billing date to avoid being charged for the subsequent billing period.

4.4 No Refunds

All fees are non-refundable. Once a payment has been processed, no refunds will be issued for any reason, including but not limited to: partial use of a billing period, dissatisfaction with the Service, failure to cancel before the trial period ends, or failure to cancel before a renewal date. By subscribing, you acknowledge and agree to this no-refund policy. This does not affect any rights you may have under applicable consumer protection laws that cannot be waived by agreement.

4.5 Price Changes

We reserve the right to change our subscription pricing at any time. If we change pricing, we will provide at least 30 days' notice via email before the new pricing takes effect. Your continued use of the Service after the price change constitutes your agreement to the new pricing.

5. Not Investment Advice

BigLog Pro does not provide investment advice, trading recommendations, or financial guidance of any kind. All content, analytics, insights, statistics, reports, and information provided through the Service — including but not limited to pattern analytics, Monte Carlo simulations, Kelly Criterion calculations, tilt detection, and any AI-generated content — are for informational and educational purposes only and should not be construed as investment advice, a recommendation to buy or sell any security, or an endorsement of any trading strategy.

We are not registered with the Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), or any state securities regulatory authority as a broker-dealer, investment adviser, or in any other capacity. You should consult with a qualified, licensed financial advisor before making any investment or trading decisions.

6. Trading Risk Acknowledgment

By using BigLog Pro, you expressly acknowledge and agree that:

  • Trading involves substantial risk of loss. Trading securities, options, futures, and other financial instruments carries a high degree of risk and may result in losses exceeding your initial investment. Trading is not suitable for all investors.
  • Past performance is not indicative of future results. Historical trading data, analytics, and performance statistics displayed in the Service do not predict, guarantee, or indicate future performance or results.
  • You are solely responsible for your trading decisions. Any decisions you make to buy, sell, or hold any financial instrument are made entirely at your own discretion and risk. BigLog Pro has no involvement in and bears no responsibility for your trading activity.
  • Simulated and hypothetical results have limitations. Any simulated or hypothetical performance results (including Monte Carlo simulations and what-if analyses) do not represent actual trading, may not account for all market factors, and are subject to the benefit of hindsight.
  • Data accuracy is not guaranteed. While we strive for accuracy, we do not guarantee that trade data, calculations, analytics, or reports are free from errors. You are responsible for verifying the accuracy of all information before relying on it.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems or infrastructure
  • Interfere with or disrupt other users' access to the Service
  • Upload malicious code, viruses, or harmful content
  • Resell, redistribute, or sublicense the Service without authorization
  • Scrape, crawl, or harvest data from the Service by automated means
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to provide services to third parties without our written consent

8. Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by the Company and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your trading data remains your property. By using the Service, you grant us a limited, non-exclusive license to process, store, and display your data solely for the purpose of providing the Service to you. We will not sell, share, or use your trading data for any purpose other than providing the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE
  • THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED
  • ANALYTICS, INSIGHTS, OR REPORTS WILL IMPROVE YOUR TRADING RESULTS

YOU USE THE SERVICE AT YOUR OWN RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM THE COMPANY OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, OR INCOME
  • TRADING LOSSES OR LOSSES FROM INVESTMENT DECISIONS
  • LOSS OF DATA OR DATA CORRUPTION
  • LOSS OF GOODWILL OR BUSINESS OPPORTUNITIES
  • COST OF PROCUREMENT OF SUBSTITUTE SERVICES
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE

IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, lawsuits, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service
  • Your trading decisions, trading activity, or investment losses
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any content or data you submit to the Service
  • Your infringement of any third-party rights

You irrevocably release and discharge the Company from any and all claims, demands, and causes of action resulting from or connected with your use of the Service, including any claims related to trading losses, missed opportunities, or reliance on any information provided through the Service.

12. Data Backup and Loss

It is solely your responsibility to maintain backup copies of your trading data. While we make reasonable efforts to maintain data integrity, we are not liable for any loss, corruption, or destruction of data stored on our servers. You acknowledge that no data storage system is completely secure or immune to failure, and you agree to maintain independent records of your important trading data.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any controversy, dispute, or claim arising out of or relating to these Terms, the Service, or the relationship between you and the Company, including any claim that arose before the existence of these Terms, shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.

Each party shall bear its own costs and expenses in connection with the arbitration, unless otherwise determined by the arbitrator. The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately. Sections 5, 6, 9, 10, 11, 12, 13, 15, and 16 of these Terms shall survive termination.

15. Data Retention and Deletion

Upon expiration of your free trial or cancellation of your subscription, your account data — including trade records, journal entries, analytics, playbooks, and any other user-generated content — will be retained for thirty (30) days. During this retention period, you may reactivate your account by subscribing, and all data will be restored.

After the 30-day retention period, all account data will be permanently and irreversibly deleted from our systems. We are not responsible for any loss of data resulting from account expiration or cancellation.

You may request immediate deletion of your account and all associated data at any time by contacting us at mike@biglogtraders.com. Such requests will be processed within five (5) business days.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted hereunder, you agree to submit to the personal jurisdiction of the state and federal courts located in the State of Texas for the purpose of litigating any such dispute.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email to the address associated with your account or by posting a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and the Company regarding the use of the Service and supersede all prior agreements, communications, and understandings, whether written or oral.
